1. Services Provided

HostDomination.com provides the following services:

  • Graphic design and development of customized websites.
  • Hosting setup and domain management.
  • Technical advice for websites, plugins, features and security.

2. Data provided by users

  1. Any data provided by users through forms, emails, or other means (e.g., name, email address, social security number, company information) is provided under the sole responsibility of the user.
  2. HostDomination.com cannot be held responsible for:
    • Errors, omissions, or incomplete information provided by you;
    • Loss, theft or misuse of transmitted data;
    • Issues arising from the registration or management of third-party accounts (e.g. Aruba, domain providers).

3. Accounts and access to third-party services

If HostDomination.com create or set up accounts with third-party providers (e.g., Aruba, domain registrars, or third-party hosting providers):

  • The user must provide accurate information and keep their login credentials confidential.
  • HostDomination.com will not be liable for unauthorized access, lost passwords, or issues with third-party accounts.
  • Any existing accounts remain your responsibility and HostDomination.com can only provide technical support.

4. Website Delivery

  1. The website will be delivered according to the agreed terms and timing.
  2. Any delays caused by:
    • Incomplete information provided by the user;
    • Changes required after the start of the project;
    • External technical issues
    will not be attributable to HostDomination.com.
  3. After delivery and completion of payment, HostDomination.com will not be liable for:
    • Content posted or managed by you on the Website;
    • Malfunctions caused by actions or modifications made by the user or third parties;
    • Violations of copyright or applicable laws committed by you;
    • Security issues resulting from unauthorized modifications or plugins.

5. Backup and Security

  • You are responsible for regularly backing up your content and data.
  • HostDomination.com does not guarantee the recovery of lost data after the delivery of the website, nor continued access to hosting services provided by third parties.
  • You are responsible for the security of your passwords and accounts.

6. Intellectual Property

  • All materials, code, templates, and designs provided by HostDomination.com will remain owned by the company until full payment is made.
  • The user acquires the right to use such materials only after payment of the agreed amount in full.
  • Unauthorized copying, sale or distribution of the materials provided is prohibited.

7. Aruba Domain Registration and Services

  • If HostDomination.com provide assistance with domain registration through third-party providers:
    • You must provide accurate and up-to-date information;
    • HostDomination.com will not be responsible for existing accounts, registration issues, or issues related to domain management.
  • You are responsible for maintaining your domain and paying any annual renewal fees.

8. Payments and costs

  • All payments must be made according to the agreed terms and methods of payment.
  • The website will only be delivered after receipt of full payment.
  • Changes or additional requests made after delivery may incur additional charges.

9. Limitation of Liability

HostDomination.com cannot be held liable under any circumstances for:

  • Direct, indirect, incidental, or consequential damages arising from the use of the website.
  • Loss of data, business interruption, or website malfunction.
  • Any violation of any law, copyright, or regulation committed by you.
  • Errors or omissions in the information you provide.

10. Acceptance of Terms

  • Your use of the website and services constitutes your acceptance of all of the terms stated herein.
  • You acknowledge that you have read, understood and agreed to these Terms and Conditions before providing any data, personal information or requests for services.

  • Your continued use of the services following such changes constitutes your acceptance of the updated Terms and Conditions.

12. Applicable law and jurisdiction

  • These Terms and Conditions are governed by the Italian law.
  • Any dispute shall be subject to the exclusive jurisdiction of the court of Rome Area, Italy.

Final Notice

By using our services, you confirm that you take full responsibility for the data provided, the content published on the website and any technical choices you make. HostDomination.com operates solely as Technical Service Provider and assumes no legal, civil, or criminal liability for the final use of the website.

These Terms and Conditions govern the purchase, activation and use of the commercial license of Host Domination Booking Engine PRO (“Software”, “Plugins” or “PRO”), as well as access to related licensing, update and support services provided through the Host Domination infrastructure.

By purchasing, activating or using a PRO license, the Customer declares that he has read and accepted these Terms and Conditions.

1. PRO License

The PRO license allows the Customer, for the duration and within the limits of the purchased plan, to access the PRO features, license activation and verification systems, software updates and any support services expressly included in the relevant plan.

The number of sites, domains, or installations that are simultaneously authorized depends on the license plan you purchase.

Purchase of the license does not transfer ownership of the Host Domination brand, license keys, update infrastructure, servers, services, or other proprietary items not covered by any applicable open source licenses.

If all or any part of the Software is distributed under the GNU General Public License (GPL) or other open source license, the rights under that license remain unaffected. These Terms separately govern the commercial services related to the PRO license, including activation, upgrades, licensing infrastructure, support, and access to Host Domination services.

2. Site and license verification

For reasons of security, prevention of abuse, protection of licenses, management of updates and verification of the legitimate use of PRO services, Host Domination can verify the site or domain on which a PRO license is activated.

During license activation and in the normal operation of the Plugin, the Software may therefore periodically communicate with the Host Domination servers.

This technical communication can be used to verify the validity of the license, the domain on which it is active, compliance with the maximum number of installations allowed, the installed version of the Plugin, the availability of updates and their completion, as well as to prevent fraudulent, abusive or unauthorized use.

Audits can also be used to diagnose problems with the activation or update system and to protect the Host Domination infrastructure from abnormal, abusive, or potentially malicious requests.

This verification does not constitute administrative access to Customer’s WordPress site and does not authorize Host Domination to access, modify or manage the content of the site.

3. Technical information regarding installation and updates

For license verification, security, and update management purposes, Host Domination may receive and record limited technical information related to the PRO installation, including:

  • URL or domain of the site;
  • installed version of Host Domination Booking Engine PRO;
  • previous version and new installed version of the Plugin;
  • date and time of a successfully completed update;
  • date and time of the last communication with the Host Domination servers;
  • technical status of the installation, such as whether the plugin is up to date or whether a new version is available.

This specific verification function does not require access to reservation data, guest data, WordPress administrative credentials, or site content.

Host Domination applies the principle of data minimization and aims to process only the technical information reasonably necessary for license management, security, update distribution and related services.

4. Safety and Abuse Prevention

Customer acknowledges that license and domain verification is also intended to protect legitimate license holders, update distribution infrastructure, integrity of Host Domination services, and other users.

Host Domination reserves the right to carry out automatic security checks and to temporarily limit or block requests that are manifestly anomalous, abusive, fraudulent or potentially impair the security, stability or availability of its infrastructure.

5. License Key

The license key is intended for the Customer and the number of installations allowed by the purchased plan.

Customer is responsible for properly storing its license key and must take reasonable precautions to prevent its public disclosure or use by unauthorized parties.

If there is reasonable evidence of abuse, compromise, unauthorized sharing, over-limitation, or fraudulent activity, Host Domination may request verification, disable unauthorized installations, regenerate or replace the key, temporarily suspend access to updates, or, in severe cases, suspend or terminate access to commercial services linked to the license.

6. Technical requirements and compatibility

The Software is designed to work in WordPress environments that are compatible with the technical requirements set out in Host Domination.

Host Domination does not guarantee compatibility with any past or future version of WordPress or PHP, any theme, third-party plugins, customization, hosting configuration, caching system, firewall, security system, or external service.

Using outdated versions of WordPress, PHP, the Plugin, or its dependencies may cause malfunctions, incompatibilities, or security risks.

7. Software Updates

Host Domination may publish updates intended to correct errors, improve performance, introduce new features, modify existing features, maintain compatibility, fix security issues, or adapt the Software to changes in WordPress or third-party services.

The Customer is responsible for installing available updates.

Host Domination recommends that you create a full backup of your site and database before installing any software updates.

If a problem arises from the Customer’s failure to install an available and adequate update, Host Domination shall not be liable for the consequences directly attributable to such omission, to the fullest extent permitted by applicable law.

8. Backup and staging environments

The Customer is responsible for maintaining adequate and up-to-date backups of the site, database, files, configurations and other relevant information.

Before installing significant updates or making major configuration changes, it is recommended that you test in a staging or development environment, where available.

Host Domination Booking Engine PRO does not constitute a backup, disaster recovery, or restoration service for the site, unless otherwise expressly agreed.

9. Reservations and accommodation

Host Domination Booking Engine is a software tool designed to assist the Client in managing calendars, availability, booking requests and bookings.

The Customer remains solely responsible for the rates and prices set, the availability of rooms and properties, the booking conditions, cancellation policies, applicable taxes and charges, tax and regulatory obligations, communications with guests, the correctness of the information entered and the fulfillment of reservations received.

Host Domination is not a party to the contracts concluded between the Client and its guests and does not operate as a travel agency, tour operator, intermediary, property manager or manager of the accommodation facility on behalf of the Client.

10. Third-Party Services

The Plugin may interact with third-party services and platforms such as iCal systems, payment gateways, email services, Stripe, PayPal, Airbnb, Booking.com or other external platforms.

These services operate independently and are subject to their own technical and contractual conditions.

Host Domination does not and cannot guarantee the continued availability of third-party services, their synchronization times, API stability, iCal formats, changes in technical requirements, platform outages, or the business and technical decisions of their respective providers.

Any references to third-party trademarks are made solely for identification or interoperability purposes and do not imply affiliation, sponsorship or endorsement, unless expressly stated otherwise.

11. Synchronizing external calendars

Synchronization with external calendars may be affected by running WP-Cron, hosting configuration, caching systems, external vendors, iCal update intervals, network conditions, or other technical circumstances not directly controllable by Host Domination.

The Customer is responsible for periodically checking availability when operating on multiple booking channels at the same time.

The Software should not be considered an absolute guarantee against overbooking if availability depends on third-party systems that do not provide real-time synchronization.

12. Payments

If the Plugin integrates third-party payment gateways, Host Domination only provides software integration functionality and does not directly perform banking, financial or payment processing services.

Authorizations, credits, refunds, disputes, chargebacks, and other payment transactions remain subject to the systems and conditions of the relevant payment provider.

The Customer is responsible for the correct configuration of its payment accounts and for verifying the transactions received.

13. Support

Any support included in the license concerns the operation of the software Host Domination according to the officially supported features.

Unless otherwise expressly agreed, support does not include custom development, changes to third-party themes or plugins, fixing errors caused by external code, hosting administration, general WordPress administration, removing malware, recovering compromised sites, restoring backups, or issues caused by external hosting and services.

14. Availability of Host Domination services

Host Domination takes reasonable steps to keep its licensing and updating infrastructure available, but does not guarantee continuous, uninterrupted, or error-free availability.

Temporary outages may occur due to, among other things, maintenance, software updates, infrastructure failures, cybersecurity incidents, unavailability of external vendors, cyberattacks, urgent security measures, or events beyond the reasonable control of Host Domination.

15. Disclaimer of Warranties

Without prejudice to rights that cannot be legally excluded or limited, Host Domination does not warrant that the Software will be completely error-free, meet any individual needs not expressly agreed upon, be compatible with any possible configuration, prevent any human error or any possible overbooking, or guarantee specific economic results, increases in bookings, conversions or turnover.

Host Domination also does not warrant that the Software will remain uninterrupted, modified, or malfunctioned by third-party services and platforms.

Customer is responsible for assessing the suitability of the Software for its specific operational needs.

16. Limitation of Liability

Within the maximum limits allowed by applicable legislation, Host Domination shall not be liable for any indirect, incidental, or consequential damages arising out of the use of or inability to use the Software if such damages arise from circumstances not directly attributable to Host Domination.

This includes, but is not limited to, misconfigurations made by Customer, failure to install available updates, unauthorized changes to the Software, incompatibility with third-party software, hosting, WordPress or PHP malfunctions, interruptions of external platforms, delays in synchronizations, loss of information without adequate backups, compromised credentials, malware, cyberattacks, prices or availability incorrectly entered by the Customer and suspensions of third-party services.

For Customers acting within the scope of their business or professional activity, and within the limits permitted by law, any total liability of Host Domination deriving from the relevant service may not exceed the amount actually paid by the Customer for the specific license or service that gave rise to the dispute in the twelve months prior to the event.

This limitation does not apply in cases where liability cannot be legally excluded or limited, including in cases of willful misconduct, gross negligence or other mandatory remedies provided by law.

17. Customer’s Responsibilities

Customer agrees to use the Software and Host Domination services in accordance with the law and not to use them for fraudulent, abusive or unlawful activities.

You may not intentionally attempt to circumvent or interfere with the licensing systems, overload the Host Domination infrastructure, gain unauthorized access to systems or information, or impair the security or operation of the Host Domination services.

The Client remains responsible for the activities carried out through its site and the information processed through its WordPress installation.

18. Guest and customer data

Host Domination Booking Engine may allow the Customer to collect information from guests via their WordPress site.

Unless otherwise indicated for a specific Host Domination service, the Customer determines how and for what purposes such information is collected through its website and remains responsible for the preparation of privacy policies, legal bases, consent mechanisms where necessary, retention periods and other obligations under applicable legislation on the protection of personal data.

The PRO license verification feature described in these Terms is separate from the reservation data and does not require access to the content of the Customer’s reservations.

19. License term, renewal and expiration

The license term is the one specified at the time of purchase.

If there is a periodic renewal, the renewal conditions communicated during the purchase process or in the relevant customer area apply.

When the license expires, depending on the plan purchased, the Customer may lose access to new PRO updates, new version downloads, support, certain Host Domination server-based services, and new license activations or transfers.

Except for technical or legal requirements, the expiration of the license does not automatically entail the cancellation of the Plugin already installed on the Client’s site.

20. Refunds and right of withdrawal

Your rights to refunds and withdrawal are governed by the applicable mandatory law and any refund policy published by Host Domination.

If the Customer is a consumer and requests the immediate supply of digital content or services, any loss of the right of withdrawal provided for by law may only occur if the requirements provided for by applicable legislation are met.

Nothing in these Terms is intended to eliminate mandatory consumer rights.

21. Suspension and termination of services

Host Domination may suspend or terminate access to commercial services associated with a license if the payment is canceled, revoked, or validly contested, the license is used beyond the purchased installation limit, serious or systematic abuse is detected, the security of the infrastructure is intentionally compromised, a key is publicly distributed, or Customer materially violates these Terms.

Where reasonably possible, the measures taken will be proportionate to the seriousness of the breach found.

22. Intellectual Property and Trademarks

The Host Domination name, its logos, graphic elements, trade names and distinctive signs remain the property of their respective owners.

The purchase or use of a Software license does not entitle Customer to present itself as an official partner, representative, distributor or affiliate of Host Domination without express authorization.

The rights to the portions of the Software distributed under open source licenses remain governed by the applicable open source license.

23. Changes to the Software

Host Domination may modify, improve, replace, reorganize, or discontinue individual features of the Software in the course of its development.

Such changes may be necessary for reasons of security, compatibility, regulatory compliance, technical evolution, or as a result of changes made by WordPress or third-party services.

24. Changes to these Terms

Host Domination may update these Terms from time to time to reflect regulatory, technical, security, or business changes.

The most recent version may be published on the Host Domination website with an indication of the date of the last update.

If required by applicable law, any material changes affecting ongoing contractual relationships will be communicated in an appropriate manner.

25. Applicable law

These Terms are governed by Italian law, without prejudice to any mandatory rights applicable to the Customer.

If the Customer is a consumer, all the mandatory provisions provided for by consumer protection legislation, including those relating to territorial jurisdiction, remain unaffected.

26. Partial nullity

If any provision of these Terms is held to be invalid, unenforceable or unenforceable, the remaining provisions shall continue in effect to the extent permitted by applicable law.

27. Mandatory rights

Nothing in these Terms shall be construed to exclude or limit any rights, remedies or liabilities that cannot be lawfully excluded or limited under applicable law.

These terms apply to Host Domination’s paid software products, including Booking Engine PROs, paid add-ons, extensions, and related software licenses.


1. Nature of our products

The software products Host Domination are electronically supplied digital products.

After completing a purchase, customers can receive immediate access to the software, files to download, license keys, and/or activation features.

Because the digital software cannot be physically returned once it has been provided, downloaded, accessed, activated, or used, refund requests are subject to the conditions described below and any mandatory rights under applicable law.


2. Product information and intended features

Before purchasing, customers are responsible for reviewing the product description, available features, documentation, demonstrations, and technical requirements.

Host Domination Booking Engine PRO is sold and described as Booking Engine and Booking System.

It is not advertised or sold as a complete Property Management System (PMS) or as a complete channel management platform, unless a specific product description expressly states so.

The customer’s subsequent decision to need a different category of software, additional features, or a more comprehensive third-party solution does not, in itself, imply that the product Host Domination purchased is defective or not as described.


3. Digital delivery and instant access

Paid software can be made available immediately after payment.

The initiation of digital delivery may include the provision of software, files for download, license keys or activation features.

Any statutory rights of withdrawal and the applicable exceptions thereto are governed by the consumer protection rules applicable to the individual purchase.


4. Refunds before download or activation

If a purchase is covered by a statutory right of withdrawal and the digital software has not yet been downloaded, accessed, activated, or otherwise provided, the customer may request cancellation within the period provided for by applicable law.

All mandatory rights granted by applicable law remain unaffected.


5. Refunds after downloading, logging in, or activating

Except as required by applicable law, Host Domination Normally does not give refunds after a digital product has been downloaded, accessed, activated, installed or used.

This includes claims based solely on:

  • Change of mind;
  • No need for the software;
  • Decision to use another product or service;
  • Discovery, after purchase, that a different category of software would be better suited to future business needs;
  • Need for features that were not advertised as included;
  • Migration to a PMS, channel manager or other third-party platform;
  • Failure to consult the product description or available features before purchasing.

For consumers who benefit from a right of withdrawal provided for by European Union law, any exclusion or loss of the right of withdrawal for digital content will only apply if the requirements of the applicable law have been met.


6. Technical problems and faulty software

This refund policy does not limit any mandatory statutory rights in relation to defective or non-compliant digital content.

If the software does not work as advertised due to a defect attributable to Host Domination, customers should contact support and provide sufficient information so that the issue can be investigated.

Where appropriate, Host Domination will first attempt to correct the problem, provide an update, or take other steps to bring the software into compliance.

All remedies provided for by applicable consumer protection legislation remain unaffected.

Therefore, a claim based on a technical issue is treated differently than a claim based solely on a change in the customer’s business needs.


7. Compatibility and third-party requirements

Customers are responsible for verifying that their intended use matches the capabilities described for the product.

Unless otherwise expressly stated, the purchase of a Host Domination plugin does not include features belonging to a different category of software or an external service.

The absence of a feature that It was never advertised as included does not constitute a software defect.


8. Business and professional purchases

Withdrawal rights under EU consumer law generally apply to individuals acting as consumers and may not apply when the software is purchased primarily for commercial, professional, business or entrepreneurial purposes.

For purchases made as part of business or professional activities, refunds after digital delivery, download, activation or use are normally granted solely at the discretion of Host Domination, except as otherwise required by applicable law.


9. Add-ons and Extensions

Paid add-ons, extensions, and expansion products are digital software and are subject to the same refund principles described in this policy.

If Host Domination agrees, at its discretion, to refund an add-on without refunding the main product, the license and related rights to use the refunded add-on may be revoked immediately.


10. Effects of a refund

If a refund is granted, Host Domination may:

  • Revoke the relevant license key;
  • Deactivate the license authorization;
  • Remove access to future downloads and updates;
  • Stop technical support related to the refunded product.

Upon issuance of a full refund, the customer must cease using any license or rights related to the service associated with the refunded purchase, subject to any rights that cannot be legally limited.


11. License Transfer

Where permitted by the applicable license terms, Host Domination may allow the removal of the activation of a valid license from one website and its transfer to another website or eligible user.

Any transfer must comply with the terms of the applicable license.


12. Discretionary refunds

Host Domination may decide to grant a full or partial refund, as a commercial comity, in specific circumstances.

A discretionary refund does not create any obligation to grant equivalent refunds in other cases and does not change this policy.


13. Mandatory rights

Nothing in these terms is intended to exclude, limit, or replace consumer rights that cannot be legally waived or excluded under applicable law.

For consumers in the European Union, the relevant legislation includes the Consumer Rights Directive 2011/83/EU and their national transposition provisions.

Questions regarding licenses, cancellations, or refund requests can be submitted through Host Domination’s official support channels.

When you contact us, we ask you to provide the address email used for purchase, the affected product and sufficient information to identify the transaction.

These Terms and Conditions govern the website design, development, configuration and delivery services provided by HostDomination.com, hereinafter referred to as the “Supplier”, to the customer, hereinafter referred to as the “Customer”.

By accepting a quote, placing an order or paying for the service, the Customer declares that he has read, understood and accepted these conditions.


1. Object of the service

HostDomination.com creates the website on the basis of the characteristics, functionality and specifications agreed with the Client.

The service may include, depending on what has been agreed:

  • graphic design;
  • WordPress installation and configuration;
  • development and customization of the site;
  • installation and configuration of themes and plugins;
  • configuration of modules and functionalities;
  • initial loading of content;
  • technical configuration of hosting and domain;
  • additional services expressly indicated in the quote.

Any service or feature not expressly agreed upon is not considered included.


2. Materials and information provided by the Client

The Client is responsible for the accuracy, legality and completeness of all materials and information provided to HostDomination.com.

  • texts;
  • photographs and videos;
  • logos and trademarks;
  • company and tax data;
  • contact information;
  • prices and price lists;
  • information relating to products or services;
  • documents and content intended for publication.

The Client represents that it possesses all necessary rights and permissions for the use of the materials provided. HostDomination.com is not responsible for infringement of copyright, trademark, image rights or other rights of third parties arising from materials provided or approved by the Client.


3. Content and Legal Compliance

The Client is responsible for the content published on the site and for the compliance of its activity with the applicable regulations.

Unless otherwise agreed in writing, the web development service does not include legal, tax, accounting, or professional advice.

Any Privacy Policy, Cookie Policy, Terms and Conditions, information, disclaimer or other legal texts that may be included on the site at the request of the Customer have an exclusively technical or informative function and do not constitute legal advice.

The Client is responsible for verifying the adequacy and compliance of these documents with its business.


4. Privacy and data processing

The Customer remains responsible for personal data relating to its business, its customers, users, employees, collaborators and suppliers.

If, during development, HostDomination.com need to access personal data on behalf of the Customer, such data will be used exclusively for the technical activities necessary for the creation or configuration of the site.

From the moment of the final delivery of the site, the Customer assumes full responsibility for the management of the personal data collected through the site.

The Customer is therefore responsible, by way of example, for:

  • privacy policies;
  • cookies and tracking systems;
  • user consents;
  • newsletter;
  • contact forms;
  • user and customer data;
  • booking systems;
  • analysis tools;
  • advertising tools;
  • payment systems;
  • Third-party services and integrations.

Unless there is a specific subsequent management or assistance contract, HostDomination.com does not play any ongoing role in the management of the data collected by the site after delivery.


5. Site Approval and Delivery

Before final delivery, the Customer may be invited to check the site and report any errors or discrepancies with what has been agreed.

Approval of the site, request for publication, putting online or actual use of the site constitutes acceptance of the work performed, without prejudice to any mandatory rights provided for by law.

Any new features, graphic changes or interventions requested after delivery may be the subject of a new estimate.


6. Payment

The Customer is obliged to make the payment according to the agreed amounts and methods.

Unless otherwise agreed, the final transfer of the site and its rights will only take place after the Full payment of the consideration due.

Until payment is made in full, HostDomination.com may suspend the final delivery, transfer of access, or the performance of further activities.


7. Transfer of the site to the Client

Following the full payment and final delivery, the website created is transferred to the Client, who assumes control and management of it.

From that moment on, the Customer:

  • has the website;
  • manages content independently;
  • you can modify the site;
  • it can entrust its management to other professionals;
  • manages users and credentials;
  • chooses plugins, themes and services to use;
  • assumes responsibility for the maintenance and use of the site.

For original materials created specifically by HostDomination.com for the project, and within the limits of the rights that can actually be transferred, full payment entails the transfer to the Client of the relevant property rights of use necessary for the use, modification and management of the site.


8. Third-Party Software and Components

The transfer of the site does not involve the transfer of the intellectual property of software, platforms or components belonging to third parties.

They remain subject to their respective WordPress licenses, themes, plugins, fonts, software libraries, stock photographs, APIs, open source software, SaaS services, and other third-party components.

Any plugins, software, frameworks, libraries or proprietary technologies of Host Domination that already existed before the project was carried out remain the property of their respective owners and may be granted for use according to the relevant license conditions.


9. Credentials and logins

After full payment, HostDomination.com can provide the Customer with the credentials and accesses necessary for the management of the site.

From the moment of delivery, the Customer is responsible for the proper storage of credentials and the security of accounts.

HostDomination.com is not responsible for unauthorised access, loss of passwords, disclosure of credentials or improper use occurring after delivery and not directly attributable to the Supplier.


10. Post-delivery liability

With the full payment and final delivery of the site, the development activity envisaged by the assignment ends, except for any additional services expressly purchased.

From that moment on, the Customer assumes responsibility for the ordinary management, content, maintenance and use of the site.

To the extent permitted by law, HostDomination.com is not responsible for problems that occur after delivery resulting from, but not limited to:

  • changes made by the Customer;
  • interventions carried out by developers or third parties;
  • installing, modifying, or removing plugins;
  • installing or editing themes;
  • updates to WordPress, PHP, themes, or plugins;
  • subsequent software incompatibilities;
  • lack of updates;
  • malware or subsequent cyberattacks;
  • theft or compromise of credentials;
  • hosting service issues;
  • domain or DNS issues;
  • interruption or modification of external services;
  • changes to third-party APIs or software;
  • activities or content posted by the Client;
  • Failure to maintain the site.

Only those liabilities that cannot be excluded or limited under applicable law remain unaffected.


11. Maintenance, Updates, and Security

Unless a specific maintenance service has been purchased, the price relating to the creation of the site does not include assistance or continuous maintenance after delivery.

After delivery, it is the Client’s responsibility to provide for updates to WordPress, plugins and themes, the creation of backups, the security of credentials and the maintenance of the services necessary for the operation of the site.

The Customer can request maintenance, assistance or continuous management interventions separately from HostDomination.com.


12. Backup

Except for a specific backup service purchased by the Customer, after delivery the Customer is responsible for keeping updated backup copies of its site and data.

HostDomination.com does not guarantee that you will keep complete or updated copies of the site after the completion of the project.


13. Hosting, Domain, and Third-Party Services

Hosting, domains, email, CDN, payment gateways, APIs, reservation systems, and other third-party services are subject to the terms of the respective providers.

HostDomination.com cannot guarantee the continuous availability of services managed by third parties and is not liable for interruptions, price changes, changes in functionality, suspensions or terminations attributable to such suppliers.

Unless otherwise agreed, the Customer is responsible for the payment and renewal of the third-party services.


14. Post-delivery changes

Any intervention carried out after delivery by the Customer or by third parties may modify the original operation of the site.

HostDomination.com is not responsible for malfunctions, incompatibilities, loss of data or security problems resulting from such interventions.

If the Customer subsequently requests HostDomination.com to restore or correct problems caused by external changes, these interventions may be invoiced separately.


15. Future operation of the site

The site is developed to work with the versions and technical environment available at the time of creation.

HostDomination.com does not warrant that the site will continue to operate indefinitely without updates, maintenance, or technical changes.

WordPress, PHP, browsers, themes, plugins, APIs, and external services can change over time and require follow-up work.


16. Limitation of Liability

To the extent permitted by law, HostDomination.com shall not be liable for indirect or consequential damages, lost revenue, loss of business opportunity, loss of bookings, loss of customers, business interruption or loss of data resulting from post-delivery events or from services and systems not directly controlled by HostDomination.com.

Nothing in these terms shall be construed as excluding liability in cases where such liability cannot be lawfully excluded or limited.


17. No guarantee of commercial results

The creation of a website does not constitute a guarantee of increased sales, bookings, traffic, positioning on search engines or the achievement of specific economic or commercial results.

Any SEO, advertising or marketing services must be expressly agreed separately.


18. Customer’s Responsibilities

After delivery, the Customer is responsible for the use of the site and the activities carried out through it.

You are also responsible for complying with the laws applicable to your business, including, where relevant, those relating to privacy and data protection, e-commerce, consumer protection, advertising, intellectual property, taxation, payments, reservations, authorizations and licenses.


19. Aftercare

Any assistance provided free of charge after delivery constitutes a commercial courtesy and does not create a permanent obligation to maintain, manage or support.

Any ongoing services must be the subject of a separate agreement or service purchased.


20. Mandatory rights

Nothing in these terms is intended to exclude or limit rights or liabilities which, under applicable law, cannot be excluded or limited by contract.

If the Customer acts as a consumer, all rights provided for by Italian and European consumer protection legislation remain unaffected.


21. Governing Law

These conditions are governed by Italian law.

Any identification of the competent court applies exclusively to the limits permitted by current legislation and without prejudice to any mandatory rights recognized to consumers.


22. Acceptance

Acceptance of the quote, placing the order or payment for the service implies acceptance of these conditions, provided that they are made available to the Customer before the conclusion of the contract.

With the Full payment and final delivery, the Customer assumes control and management of the site in accordance with these conditions.
